Purpose

These general conditions of use (the "Conditions of Use") regulate access to and use of the pages comprising the web domain http://www.eductrade.com (the “Website”), owned by EDUCTRADE, and the contents and services included in it, by any person (the "User").

Access to the Website and/or its use by the User necessarily and automatically means the User's full, unreserved acceptance of and subjection to these Conditions of Use in their current terms and in any terms that may supplement these, amend them or substitute them regarding the services and contents of the Website.

EDUCTRADE consequently recommends the User to read the Conditions of Use carefully before accessing and/or using the Website. EDUCTRADE reserves the right at any time to make any updates, amendments to and/or replacements of the services and contents of its Website, the Conditions of Use and, in general, any elements forming part of its Website.

Use of the Website

The User undertakes to use the Website and its services and contents without infringing or abusing prevailing legislation, good faith, generally accepted usage and/or public order, always for licit effects and purposes. The User also undertakes not to damage, disable or impair the Website and/or its services and contents, or to impede the normal use of the Website by other users.

The User guarantees that his/her activities will in no event undermine EDUCTRADE's good name and commercial image for other third parties or users of the Website.

Likewise, the User expressly undertakes not to destroy, alter, disable or damage in any way the data, programs or electronic documents and other elements on the Website.

All the contents on the Website belong to EDUCTRADE. EDUCTRADE reserves any right not expressly assigned under these Conditions of Use.

Total and partial reproduction, broadcast, distribution, dissemination and/or storage of the content of the Website is prohibited in any format without prior written consent from EDUCTRADE, except in compliance with the following terms. EDUCTRADE authorises the User to visit the Website from his/her computer and/or to print Website contents for his/her personal use. However, this in no way implies authorisation for their redistribution.

The User may use the Website and its contents for his/her private and non-commercial purposes. The use of press communications and other documents classified as public is permitted in public communications, provided the source of the information is expressly and clearly indicated.

Access to the Website

The User accesses the Website under his/her own and exclusive liability. By accessing the Website, he/she fully and unreservedly accepts each and every one of these Conditions of Use. The Website contents and services are exclusively intended to disseminate information about the business activities of EDUCTRADE.

EDUCTRADE will take reasonable measures to ensure that the contents and services included on its Website are accurate and up to date. Nonetheless, EDUCTRADE is not able to guarantee these circumstances at all times, such that it does not accept any responsibility for how accurate or current the contents and services may or may not be. Considering that the User may download contents from the Website, EDUCTRADE has established the necessary infrastructure to avoid damage originating from computer viruses. Our antivirus system is reasonably secure and it updated with the latest patches that the service supplier makes available to us. For this reason, EDUCTRADE cannot accept liability for any potential damage to or errors in the User's computer system that may occur when accessing the Website.

Intellectual property and industrial property

The intellectual and industrial property rights over the Website contents are owned exclusively by EDUCTRADE unless otherwise specified. The User may create a private copy of the contents solely and exclusively for personal use. Any use or employment other than personal use will require prior written authorisation from EDUCTRADE.

The legitimacy of the intellectual and/or industrial property rights on the contents contributed by third parties and identified as so contributed, is exclusively at the liability of such third parties. The User may not publicly reproduce, broadcast, distribute or communicate (including the right to make available), transform, collect or in any other way exploit the Website contents without prior written authorisation from EDUCTRADE. Should the User do so, he/she will be infringing intellectual and industrial property rights protected by law.

Protection of personal data

Merely accessing or using the Website will not lead EDUCTRADE to collect personal data. However, if EDUCTRADE does request personal data, it will guarantee their confidentiality and security and will duly inform users of their rights, pursuant to Constitutional Act 15/1999, 13th December, on personal data protection, to Royal Decree 1720/2007, to Royal Decree 994/1999 on security measures and other applicable legislation.

Links

The EDUCTRADE Website may provide links to other contents owned by third parties. The sole object of such links is to provide the User with the possibility of supplementing information by linking onwards. EDUCTRADE thus takes no liability for any results that may ensue from the User accessing third-party sites by links on the Website. Legal provisions notwithstanding, EDUCTRADE declines any liability for the contents of the links and/or for any potential damage to or errors in the User's computer system that may occur when accessing sites via the links.

Applicable legislation and jurisdiction

These Conditions of Use will be regulated by the provisions of Spanish legal regulations. For the resolution of any dispute ensuing from access to the Website, the User and EDUCTRADE, expressly waiving their right to any other general or special jurisdiction to which they may be entitled, agree to subject themselves to the courts and tribunals of the capital city of Madrid.
